General Terms
Article 1: Applicability
These General Terms and Conditions (hereinafter referred to as “Terms”) apply exclusively to all offers, orders, and agreements made with TheGameRoom.
By accepting an offer or placing an order, you acknowledge and agree to these Terms.
Deviations from these Terms are only valid if agreed upon in writing, and all other provisions remain in full effect.
All rights and claims set out in these Terms and any subsequent agreements for the benefit of TheGameRoom also apply to any intermediaries and third parties engaged by TheGameRoom.
Article 2: Offers and Agreements
All offers from TheGameRoom are non-binding, and we reserve the right to modify prices, especially in response to legal or regulatory changes (see Article 3.6).
An agreement is only established after your order has been accepted by TheGameRoom. We reserve the right to refuse orders or attach specific conditions to the delivery unless otherwise stated. If an order is not accepted, you will be notified within ten (10) working days of receipt.
Article 3: Prices and Payments
Prices for products and services are subject to change and are listed in GBP, including VAT, unless otherwise stated or agreed in writing. The final shipping costs will be displayed at checkout.
Payment methods are shown at checkout.
TheGameRoom ensures the security of your data using Secure Socket Layers (SSL), an advanced internet security system. All payment and address details are securely encrypted and stored on a Secure Server.
If you suspect misuse of your payment details, please first contact your bank or payment provider. Additionally, notify TheGameRoom as soon as possible by emailing info@thegameroom.org. Most banks cover fraud-related losses above a certain amount.
If you fail to make a payment, TheGameRoom reserves the right to suspend or cancel the agreement.
If product or service prices increase between the time of order and fulfilment, you have the right to cancel your order within ten (10) days of being informed of the price change.
Article 4: Delivery and Collection
Delivery times stated by TheGameRoom are estimates. Exceeding a delivery time does not entitle you to compensation or the right to cancel your order unless the delay is unreasonable. In such cases, you may cancel the order if necessary.
Products are dispatched on working days once they are ready for shipment. Orders placed before 3:00 PM on a working day are typically dispatched the next working day.
You may also choose to collect your order. No shipping costs apply to this option. The collection location and time can be arranged upon request. If a phone number or email address is provided, we will contact you to arrange collection. You can also reach us at info@thegameroom.org.
Article 5: Retention of Ownership
Ownership of delivered products is transferred only after you have fulfilled all payment obligations under the agreement. However, the risk related to the products passes to you upon delivery.
Article 6: Intellectual and Industrial Property Rights
You must fully respect all intellectual and industrial property rights associated with the products supplied by TheGameRoom.
TheGameRoom does not guarantee that the delivered products do not infringe upon any third-party intellectual or industrial property rights.
Article 7: Complaints, Returns, and Liability
You must check upon delivery whether the products conform to the agreement. If they do not, you must notify TheGameRoom as soon as possible and no later than fourteen (14) days after delivery.
If a product is found to be defective, TheGameRoom may offer a replacement or refund the purchase amount upon return of the product.
If you wish to return an item for any reason, you may do so within 14 days of receiving it. Orders can also be cancelled before dispatch. Returns must be processed per product, and while we may ask for the reason, you are not obligated to provide one.
Return shipping costs are your responsibility. We appreciate it if you complete the returns form under “Contact” before sending the item back. After notifying us of a return, you have 14 days to return the order. Refunds are processed within 14 days after receiving the returned item, using the same payment method unless otherwise agreed in writing. Always include your order number when returning a product.
For services and digital content not supplied on a physical medium, you may cancel the agreement within 14 days without providing a reason. The withdrawal period begins the day after the agreement is made.
If you have a complaint, please submit it via our complaints form on the website. If unresolved, you may escalate the dispute to a recognised mediation service.
Article 8: Orders and Communication
TheGameRoom is not liable for misunderstandings, delays, or incomplete orders due to internet issues or other communication failures unless caused by intent or gross negligence.
Article 9: Force Majeure
In cases of force majeure, TheGameRoom has the right to suspend or cancel an order without judicial intervention, notifying you in writing. No compensation is required unless deemed unreasonable under the circumstances.
Force majeure includes any unforeseen circumstances beyond our control that prevent TheGameRoom from fulfilling its obligations.
Article 10: Miscellaneous
If you provide a delivery address, TheGameRoom is entitled to send all orders to that address unless you specify a different address in writing.
If TheGameRoom allows deviations from these Terms, whether explicitly or implicitly, this does not affect our right to enforce strict compliance in the future.
If any provision in these Terms is found to be invalid or contrary to applicable law, it will be replaced by a legally permissible alternative set by TheGameRoom.
TheGameRoom may engage third parties to fulfil orders where necessary.
Article 11: Applicable Law and Jurisdiction
All rights, obligations, offers, orders, and agreements governed by these Terms are subject exclusively to UK Law.
Any disputes arising between parties will be submitted exclusively to the competent courts in the United Kingdom.
